COVID-19 Policies and Proceedures
With all the preparations and plans we are all going through to reduce transmission of the Corona Virus and minimize cases of Covid-19 in our area, the Law Offices of Bridget D. Swing will be making a changes, effective immediately, to our regular office and real estate closing procedures. As always, our staff will continue to work hard to create a smooth and successful closing transactions for EVERYONE involved.
Simply put, these procedures and actions are being put into action with two important purposes in mind:
To protect the personal safety of all the stakeholders involved in the closing transactions.
To minimize the transmission of the virus
When it’s time for a closing transaction to occur, there are many participants involved, This includes our mutual clients, real estate agents, other attorneys, title companies, lenders and government offices, just to name a few….all of which have their own safety responses and procedures, which may cause additional delays and inconveniences.
Undoubtedly, there will be some hiccups along the way. We ask for your patience during this time as we all work to get your clients successfully closed on their real estate transaction.
As such, please review the guidelines below, and call our office with any questions. Thank you in advance for your cooperation!
BUYER/CASH CLOSINGS: Clients purchasing property with cash funding (and where lenders are not involved). All documents will be sent to the client directly for signature via fax or email and can be returned by fax (to 828-393-4229), scanned and uploaded online to our secure server, or delivered by overnight mail service. In-Office meetings are not required for cash closings.
BUYER/REFINANCE/LENDER: For existing clients who are scheduled to buy a property with a lender or refinancing an existing property, we are allowing limited in-office attendance when required and can offer “curb-side” closings with clients signing documents in their car in our parking lot. ALL family members, real estate agents, and those not directly involved in the purchase, and who will not be signing for a mortgage, MAY NOT come to the closing. We can include those not in attendance by telephone conference call or other methods such as Skype. This policy may be adapted or modified as needed or required by circumstances.
SELLER DOCUMENTS: Selling clients can sign documents in advance of the closing, and are not required to be present at closing. Please call our office for specific instructions on procedures on how we can minimize your face to face interactions while we prepare your closing documents. For those coming to the office, we are allowing limited in-office attendance when required and can offer “curb-side” signing with clients signing documents in their car in our parking lot. ALL family members, real estate agents, and those not directly involved in the execution of seller documents, MAY NOT come to the closing.
COMMISSION CHECKS: Real Estate Agents – Our offices will not be open to pick up commission checks. When feasible, commission checks will be delivered to the Real Estate Firm of record by personal delivery to local Hendersonville Brokerage Firms. Firms outside of the Hendersonville area and local firms closed due to their own COVID-19 proceedures will be mailed by US Postal Service. Overnight delivery can be arranged with advanced notice, but there will be a nominal charge for overnight delivery, so please call our office to make arrangements.
EARNEST MONEY DEPOSITS: When our firm is asked to hold earnest money, we have a variety options available:
1.) Checks can be overnighted or delivered by US Postal Service to our office at the following address:

Please include a note with (1) your name and Firm Name (2) clients full name and property address or PIN #. and/or a filled out Receipt of Monies page from the offer to purchase. Upon receipt, we will return the Receipt of Earnest Monies to you via email or regular mail, depending on the contact information we have on file for you.
2.) Checks can be delivered left in the “drop-box” which will be located outside the front door of our office during normal hours of operation (9am-5pm, Mon- Fri.). WITH PRIOR APPROVAL ONLY from our office staff, you can drop EM checks off and place them in our mail box outside our building. This way we can immediately go out to pick up your check and send the receipt as soon as possible, with no danger of the postman taking it away.
As above, please include a note with (1) your name and Firm Name (2) clients full name and (3) property address or PIN #. Upon receipt, we will return the Receipt of Earnest Monies to you via email or regular mail, depending on the contact information we have on file for you.
3.) Wire Transfer – Earnest money can also be wired directly to our trust account. Please call the office for more details.
MISCELLANEOUS DROP OFF: Documents can be left in the “drop-box” which will be located outside the front door of our office during normal hours of operation (currently set from 9 am – 5 pm, Mon- Fri.). WITH PRIOR APPROVAL ONLY from our office staff, you can drop documents off and place them in our mail box outside our building. This way we can immediately go out to pick up your check and send the receipt as soon as possible.
IMPORTANT WIRE FRAUD INFORMATION: Times of upheaval and stress are excellent opportunities for criminals to create more confusion and to execute wire fraud – we ask ALL PARTIES to be vigilant and aware of circumstances, and remind everyone to take extra care during this time.
